1. Scope and Provider

These terms and conditions (AGB) apply to the use of the HugoSMP Market website (hugosmp-market.net, hugomarkt.net, hugomarket.net) and the associated Minecraft and Discord bots. The provider is the person named in the imprint. Contact: [email protected] and Discord @amangoworm. They become part of the agreement by using the website, and at the latest by logging in. Without an account, they apply accordingly where applicable.

2. Not an Official Service

HugoSMP Market is an independent fan project. It is not operated by or affiliated with the operators of the Minecraft server hugosmp.net. NOT AN OFFICIAL MINECRAFT PRODUCT. NOT APPROVED BY OR ASSOCIATED WITH MOJANG OR MICROSOFT.

3. Services

The website provides market prices, statistics, tools and a marketplace for players of hugosmp.net, among other things. Use is free of charge. The data shown is collected automatically and may be incomplete, outdated or wrong. There is no entitlement to any particular availability, feature or to the continued existence of the service. Features may be changed, restricted or discontinued at any time.

4. Use of the Provided Data

The data, interfaces and tools shown on this website are intended only for using the website itself. Without prior permission from the provider, you may not use them to create a competing product or to build a private script, bot, scraper or your own API on top of them.

We cannot assess what such reuse would be used for or whether the rules of hugosmp.net would still be followed. You can ask for permission by emailing [email protected] or on Discord @amangoworm.

5. Account

You log in with your Minecraft account on hugosmp.net or a linked Discord account. You are responsible for all activity on your account and must not share it with others. You can have your account deleted at any time by emailing [email protected].

6. Virtual Currency

All amounts, prices, balances and payments shown on this website (e.g. "$") refer exclusively to the virtual in-game currency of the Minecraft server hugosmp.net. This currency has no real-world value, is not legal tender and cannot be exchanged for real money or anything else of value through HugoSMP Market.

Market+ and other paid features are paid for exclusively with this in-game currency. No purchases with real money are offered on this website. There is no entitlement to compensation, in particular not in real money, for lost in-game currency or items, for example due to decisions, resets or bans on hugosmp.net.

7. Marketplace and Player-to-Player Trading

Players can post offers and negotiate deals on the marketplace. The actual trade takes place between the players in-game at their own responsibility. HugoSMP Market is not a party to any trade and does not guarantee that a deal is completed. Trading for real money (IRL trading) and any form of scamming are prohibited. The rules of hugosmp.net apply in addition. Scams can be reported via HugoGuard or our Discord support.

8. Conduct and Moderation

In particular, illegal, insulting, discriminatory or misleading content, spam, exploiting bugs, automated mass requests that impair operation, using the data without permission for a competing product or a private script, and attempts to use other people's accounts are not allowed.

In case of violations, we may remove content, restrict features or suspend accounts temporarily or permanently. Each case is reviewed by the operator. Where possible, we inform you of such a measure and the reasons for it. Reports of illegal content and objections to moderation decisions can be sent to [email protected].

9. Voluntary Support via Ko-fi

HugoSMP Market is free and privately run. If you like, you can leave a voluntary tip at ko-fi.com/hugomarket to help cover development and server costs.

• Support is voluntary and given without anything in return. It does not entitle you to features, perks, in-game currency or the continuation of the project.
• Tips are not tax-deductible, and no donation receipts can be issued.
• Payments are processed by Ko-fi and its payment providers, whose terms and privacy policies apply.
• If you paid by mistake, please contact [email protected] promptly.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. As the service is free of charge, liability for slight negligence is otherwise excluded. In particular, we are not liable for decisions made based on the prices or statistics shown.

11. Changes

We may amend these terms with effect for the future, for example when adding features or when the law changes. We announce material changes on the website. If you do not agree, you can stop using the service and have your account deleted.

12. Governing Law

German law applies. If you are a consumer, mandatory consumer protection laws of the country where you habitually reside remain unaffected. Should any provision be invalid, the remaining provisions remain valid. In case of doubt, the German version of these terms prevails.
